The Bankruptcy Process

Chapter 7 Bankruptcy Process

Both the Chapter 7 and Chapter 13 bankruptcy processes have the same general procedure.  Before bankruptcy can be filed for, you must complete a mandatory Credit Counseling course.  The attorney will need all the relevant and required information on your income, expenses, debts owed, etc. for the Bankruptcy Court petition.  You become protected from creditor harassment after your petition is filed—this alone can bring a great deal of relief.  30 days after filing, a Statement of Intention is required concerning your secured debts.  About 5 weeks after filing a “341 Meeting” is held with all creditors and within particular deadlines (see Bankruptcy Timeline ) after that meeting, creditors and the trustee may file any objections.  60 days after the 341 Meeting, a Chapter 7 bankruptcy discharge occurs freeing you from debts!

Chapter 13 Bankruptcy Process

The Chapter 13 process is very similar to that for Chapter 7.  There is an additional filing that must be done with the petition or within 15 days of filing—this is the repayment plan.   If all payments are adhered to according to the payment plan, the debt will be discharged 3-5 years after the 341 Meeting.
